Beskrivelse
1 - Introduction - description of the service Norsk Tipping plans to enter into a contract for nationwide communication from Telia Norge AS (Tidligere TDC AS) (Anskaffelse, NT-0050-16). The contract includes the delivery of communication between Norsk Tipping ́s terminals and the main office. A terminal is a playing terminal located at the agents. Negotiations have been made with Telia Norge AS for an extension of the current operational agreement, NT-0050-16. The original contract is valid until 31.03.2025. The contract extension means that the operational contract will continue to run after the original expiry date, with a duration of three years from and including 01.04.2025. 2 - Legal assessment - justification for the intention notice. The procurement regulations aim to promote effective use of society ́s resources, cf. the Public Procurement Act § 1. In this case Norsk Tipping has carried out an assessment and considers an extension of the current agreement with Telia Norge AS to be the most efficient use of society's resources. It is in accordance with the Public Procurement Regulations (FOA) § 28-1 letter f that the contracting authority can legally make a change in a contract without holding a competition if changes are made that are "not significant". Furthermore, the Public Procurement Regulations § 28-2 states that an amendment is always significant if the change applies to new terms which would have led to other tenderers potentially participating, or that another tenderer could have been awarded the contract. Furthermore, an amendment will always be significant if it significantly changes the contract ́s financial balance to the advantage of the tenderer or significantly extends the scope of the contract. At the time of the previous procurement there were no plans to close the current terminal system, and it was a prerequisite that a new procurement for the same service was published when the contract period expired, 01 April 2025. However, Norsk Tipping has now decided to close the current terminal system. Currently the number of terminals is 2990. This number is reduced from month to month and is expected to zero during the year 2027. What the starting number makes up 31.03.2025 is difficult to say now, but if the current development continues it will be significantly lower than 2990. This is therefore an important premise in the change that is now intended to be implemented in the extended agreement with Telia. Norsk Tipping does not consider it probable that several tenderers would participate in the competition if this phasing-out change was known at the time of the tender, cf. the Public Procurement Regulations § 28-2 letter a. Norsk Tipping further received tenders from two actors, which was expected. According to Norsk Tipping's assessment, the change would not mean that another tenderer would have won the competition. On the other hand, it can be argued that three years is a relatively long extension up to the original contract time of 8 years. An important counter-argument is that in the three year period the terminal system shall be phased out and zero. If Norsk Tipping is now publishing a new competition, both a new tenderer and Norsk Tipping would spend large sums of money implementing the new system, as well as replace fully usable hardware with new ones. In this perspective, 3 years becomes a very short time. Norsk Tipping deems this an unsustainable solution, both economically and environmentally (the Award criterion Environment and sustainability 30%). Norsk Tipping deems that the agreed extension does not significantly extend the scope of the contract, cf. the Public Procurement Regulations § 28-2 letter c. As the number of terminals decreases, the tenderer ́s allowance will also be reduced. The amendment will, thus, not change the contract ́s financial balance to the advantage of the tenderer, cf. the Public Procurement Regulations § 28-2 letter b. 3 - Assessment of alternatives in accordance with the competition. Norsk Tipping has considered the possibility of announcing a new competition for the provision of nationwide communication. As mentioned above, this would be a short-term contract, set against the costs required for the implementation of a new competition and implementation. Norsk Tipping has estimated what this cost will be, see the assessment below. In order to provide communication, new infrastructure must be established. Concerns lines, access points, configuration, etc. This means that any new supplier will have to invest significantly in new infrastructure. New infrastructure (operation and traffic costs not included) for 2,900 agents is estimated at a cost in the range of NOK 15 million to NOK 20 million. In addition, a new agreement would need to have a regulation that relatively quickly scales down the number of agents. The cost of implementing the new supplier will therefore approach the total cost of the service itself over these three years. Norsk Tippi
